CONDITIONS OF ACCEPTANCE OF ADVERTISEMENTS
In these Conditions the Term "advertiser" means the party who books the space and is responsible for payment.
ORDERS
1. 4x4Galore Video Productions reserves the right to refuse, amend, withdraw or cancel any order of advertisement or series of such at any stage, or otherwise deal with all advertisements submitted at their absolute discretion and without explanation. All advertisements must comply with the Australian Code of Advertising Practice, and not in any way contravene existing legislation or be defamatory.
2. 4x4Galore Video Productions will not be liable for any loss or damage, consequently other wise occasioned by error, late publication or the failure of an advertisement to appear from any cause whatsoever.
3. In no circumstance does the placing of an order confer the right to renew on similar terms.
4. 4x4Galore Video Productions reserve the right to increase advertising rates at any time or to amend the terms of contract regarding space or frequency of insertion. In such event the ADVERTISER has the option to cancel the balance of the contract without surcharge.
5. 4x4Galore Video Productions reserves the right to refuse cancellations or transfers unless they are received in writing 10 days before the copy deadline.
6. If the ADVERTISER cancels the balance of a contract, except in the circumstances stated in paragraph 5 above, all unearned series discount will be surcharged. 4x4Galore Video Productions reserves the right to surcharge in the event of conditions not being completed within the contractual period.
7. Credit accounts are strictly net and must be settled within the time period specified on Invoice. If an account is overdue 4x4Galore Video Productions reserves the right to suspend insertion and/or cancel the balance of the contract and surcharge all unearned serious discount.
8. In the case of pre-payment accounts, 4x4Galore Video Productions reserves the right to cancel the balance of the contract and surcharge all unearned series discount if payment is not received by the stipulated pre-payment deadline date.
COPY / PROOFING / VOUCHERS
9. Copy must be supplied without application from 4x4Galore Video Productions. In the event of copy instructions not being received by the copy deadline 4x4Galore Video Productions reserves the right to repeat the last copy used.
10. 4x4Galore Video Productions cannot accept responsibility for changes in dates of insertions and copy unless they are confirmed in writing and in time for the changes to be made. 4x4Galore Video Productions reserves the right to charge for any additional expense involved in such changes.
11. Copy of matter must conform to 4x4Galore Video Productions requirements.
12. Provided copy is received by the stipulated copy deadline date 4x4Galore Video Productions will provide one proof if requested and if it is practicable to do so. Any extra proofs will be charged for. It is the responsibility of the ADVERTISER to inform 4x4Galore Video Productions of any alterations required.
13. It is the responsibility of the ADVERTISER to check their advertisement after the first insertion. 4x4Galore Video Productions will not be responsible for any errors on subsequent insertions which have not been advised to them.
14. The ADVERTISER shall be responsible for the insurance of all blocks, artwork and other advertisement material delivered by him to 4x4Galore Video Productions and 4x4Galore Video Productions cannot accept any liability for any loss or damage.
15. 4x4Galore Video Productions reserves the right to destroy all blocks and other materials which have been in its custody for 6 months provided always that the ADVERTISER, or his agent, has not given written instructions to the contrary. 4x4Galore Video Productions may exercise this right in giving further notice to the ADVERTISER.
The placing of an advertisement order will be deemed an acceptance of these conditions, September 2007.
